This delay is called an adjournment. During this adjournment, we’ll negotiate on your behalf with the prosecuting authority. You approve the reduction we’ve negotiated. The Court rules on the reduction and sets a fine. You pay the fine. You’re done. That’s it. You usually don’t have to go to Court, you don’t have to speak to a Judge, you don’t have to haggle with a police officer. You sign retainer authorizing us to represent you and obtain a copy of your Abstract of Driver’s Record through our telephone link with the Dept. of Motor Vehicles. You pay our fee (which we’ll quote you) by either check, money order or credit/debit card and you send us the Court papers that you have along with the fee. (we send you the postage paid envelope in which to do that, by the way!) We contact the Court, negotiate with the prosecutor/officer and obtain a plea reduction agreement. If necessary, we send that agreement to you for your signature. You sign it and send it to the Court (we send you the postage paid envelope for that too!) Either we or the Court notifies you of whatever fines may be owed and any other conditions to the reduction. You pay the fines directly to the Court and comply with those conditions. You’re done! All that without having to step foot in a Courtroom and wait, and wait and wait for your name to be called! *In fact, in most jurisdictions along the New York State Thruway (I87 South of Albany, I90 West of Albany), the Adirondack Northway (I87 North of Albany) and many, many others, we usually prevent you from having to EVER STEP FOOT IN A COURTROOM to handle your traffic matter. In fact, in most cases, the farthest you’ll ever have to go is YOUR MAILBOX! **Of course, because every insurance carrier is different, we can’t say for certain what will happen to your insurance as a result of your case. At this point you may have some questions about the process we're going to be going through to resolve this. How long will it take? What sort of fines can I expect? Etc. Anticipating this, here are answers to the most common client questions. If you have any further questions - of course - feel free to call. 1) Q: Do we handle DWI cases? A: No. DWI cases in the Albany area we take in and refer to another attorney. You may feel free to contact us for these matters and we will gladly refer you to an attorney who may consider taking your case. 2) Q: If I hire you instead of pleading guilty, will my insurance premiums go up? A: Usually not. It really depends on your insurance company. In my experience - after a plea negotiation - a driver's rates will increase if the driver's record has accumulated several points and speeding points in particular. Usually we're dealing with speeding tickets. Usually we get these pled down to non-speeding tickets. Usually this doesn't result in insurance changes. BUT your results may be different depending on the circumstances surrounding your particular case. 2) Q: Will I get points on my license? A: If you've been charged with a speeding ticket and you have a clean record, we usually can avoid points being added to your record. It really depends on what speed you're charged with, your driving record and - frankly - the mood of the particular Court and prosecutor we're dealing with. Of course, if the speed you're charged with is really crazy (over 20 m.p.h. over the posted limit) the task of eliminating the points entirely becomes harder and usually isn't possible. Even in those cases, however, we almost always can - at least - get the points significantly reduced, sometimes by as much as half or more! 3) Q: Can you tell me how much my fine will be? A: There are two components to fines that are issued. The first is the actual fine which will vary depending upon what you plead to, and what the State says the Court can charge for a minimum and maximum fine. These depend upon what particular violation you're charged with and how recently and how often you've been convicted of the same offense and what your driver's record reveals to the Court. The second component is the mandatory State surcharge. This depends on when you were accused, whether you plead to a moving or nonmoving violation and how many and what charges you plead guilty to. Most clients - for most single speeding tickets - end up paying between $100 and $250 in fines. Again, however, it depends on the law, your driving record and the mood of the Court. I've seen some rural jurisdictions charge fines as low as $50. I've seen some Courts charge fines in excess of $500 for a multiple, habitual violator. Folks, I'm a lawyer (and a pretty good one). I'm not a magician! 4) Q: Can I pay a higher fine and get less points? A: In my experience, most Courts do not allow this anymore. My priorities as your attorney will pretty much be as follows: 1) to keep you out of jail if you've been charged with a misdemeanor. 2) to keep your driving privileges intact or restore them as quickly as possible if they've been abridged. 3) to minimize the points you eventually are assessed with. 4) to minimize your fines if you suffer from a specific, verifiable hardship in the eyes of the Court. 5) Q: How long will this take? A: The whole process from my initial contact with the prosecuting authority to the assessment of your fine usually takes between 5 and 10 weeks. I feel a little like the phone or cable company giving you such a wide window but so much of the time this process takes is up to the Court. Some Courts are right on top of their paperwork, some Courts are just so busy with traffic court and other matters that they are backed up - literally - months! The bright side is that it means you'll have more time to either keep the fine money for yourself or save it up for the Court. Basically, when you need to know something, I'll be in touch with you.
